All officers and employees of the Council or of any agency established or recognised under sub-section (1) of section 7and all surveyors, samplers and employees of testing houses, referred to in sub-section (2) of that section shall, while acting or purporting to act in pursuance of the provisions of this Act or any rule or order made there under, be deemed to be public servants within the meaning of section 21 of the Indian Penal Code (45 of 1860).
